Brazil's Largest Lithium Mine Was Halted by a Radius, Not a Regulator

A federal judge suspended every environmental licence at Grota do Cirilo over a 2.721 km distance to the Baú quilombola territory. The 8 km rule that did it was confirmed on appeal in May. Sigma says it has not been served.

Sigma Lithium’s Grota do Cirilo, which the company calls the largest industrial-mineral lithium oxide concentrate operation in the Americas on a USGS basis, was not stopped by geology, by price, or by a mining regulator. It was stopped by a number: 2.721 kilometres, the distance Brazil’s land agency says separates the project’s directly affected area from the boundary of the Baú quilombola territory in Araçuaí, Minas Gerais. The threshold is 8 km. On September 4 a federal judge suspended the effects of every environmental licence at the project and ordered mining halted [Brasil de Fato, September 6, 2026; Reuters via MINING.COM, September 6, 2026].

Three days later Sigma said it had received no legal communication about the ruling and that operations continue [Sigma Lithium, September 7, 2026]. Both can be true at once, which is what makes this a supply story rather than a courtroom story.

What’s happening

  • Judge Antônio Lúcio Túlio de Oliveira Barbosa, in Teófilo Otoni (TRF-6), signed the injunction on September 4 in Ação Civil Pública nº 6012059-96.2026.4.06.3816/MG, brought by the Federation of Quilombola Communities of Minas Gerais (N’Golo) against the state, its environment foundation Feam, Incra, and Sigma Mineração [Brasil de Fato, September 6, 2026].
  • The order suspends all existing licences, halts mining, and bars Minas Gerais and Feam from issuing new ones, including expansions and corrective licences. Non-compliance carries a fine of R$ 100,000 per act [Brasil de Fato, September 6, 2026].
  • Incra put the distance from the directly affected area at 2.721 km for Baú and 3.691 km for Genipapo Pintos in Itinga, in a filing signed June 26, 2026. Both sit inside the 8 km radius in Annex I of Portaria Interministerial nº 60/2015, which presumes quilombola impact for mining outside the Legal Amazon. Sigma says the project falls outside it, measured from the IBGE census marker, which locates only dwellings; Incra measures from the RTID territory perimeter gazetted in November 2023 [Brasil de Fato, September 6, 2026].
  • Grota do Cirilo is Sigma’s only producing asset, nameplate 330,000 tonnes a year of lithium oxide concentrate [Reuters via MINING.COM, September 6, 2026; Sigma Lithium, September 7, 2026].

Brazil angle

The judge accepted exactly one piece of evidence: a cartographic georeferencing survey, limited to proving the distance between the two perimeters. Claims about air, water, noise and anthropological impact were refused as belonging to the administrative track. Sigma advances the expert’s full fee, and the report is due in 45 days, roughly October 19 by desk arithmetic [Brasil de Fato, September 6, 2026].

The agreement point deserves precision, because both sides are being reported loosely. N’Golo asked the court to block the conduct-adjustment agreement (TAC) between Sigma and the state, and the judge refused, reasoning that with licences already suspended and mining stopped, extraction stays interrupted regardless of any state arrangement. So Sigma is right that the ruling did not strike down its TAC [Sigma Lithium, September 7, 2026]. The decision is also explicit that the TAC does not authorise a restart [Brasil de Fato, September 6, 2026]. Those are compatible, and the gap between them is the investment case.

US angle

The Western case for Brazilian tonnes has rested on an implicit premise: that friendly jurisdictions carry engineering and offtake risk, not consent risk. This ruling prices consent risk directly. The ore body is unchanged and the plant works. The constraint is a procedural finding about a community 2.721 km away that no capital schedule can accelerate, and it is the kind of risk a buyer cannot diligence out of a supply agreement.

China angle

Sigma describes itself, citing USGS, as the largest industrial-mineral producer of lithium oxide concentrate in the Americas, its site the fifth largest such complex globally [Sigma Lithium, September 7, 2026]. That is the unit of Western-hemisphere supply now behind an injunction and a 45-day survey. Whatever share of it slips, the marginal replacement tonne is priced in China. Beijing need not act. It becomes the residual supplier while a rival jurisdiction litigates a radius.

Africa and LATAM angle

The plaintiffs are Afro-descendant communities whose claim runs through ILO Convention 169, incorporated into Brazilian law by Decree nº 5.051/2004 and later Decree nº 10.088/2019. Because the obligation flows from an international convention that Brazilian courts treat as supralegal rather than from a domestic mining rule, the reasoning travels. It has already travelled once. In May the Fourth Panel of the TRF-3 upheld a first-instance bar on the mining agency ANM granting new permits in the José Joaquim de Camargo quilombola territory in Votorantim, São Paulo, without consultation, together with an additional 8 km protective strip. ANM argued the order was unenforceable because the territory is not formally identified and delimited. On the vote of reporting judge Mônica Nobre, the panel held that the absence of an Incra title does not displace the convention, because Article 68 of the ADCT makes titling merely declaratory [TRF-3, May 12, 2026].

What it means

That untitled-means-unprotected defence is the one the sector relied on, and it is now gone at the appellate level and being applied to the hemisphere’s largest such operation. The binding parameter is a fixed radius in a 2015 rule, not a discretionary environmental judgement. Incra’s position, in turn, is that a Fundação Cultural Palmares self-declaration certificate is enough to trigger the quilombola process whatever stage the land titling has reached, and for Baú that titling has been open since 2009 [Brasil de Fato, September 6, 2026]. Legible for underwriters, hard to engineer around.

The distance is contested and an expert will settle it. The applicability of the radius, if the distance falls inside it, is not. Sigma is guiding to 240,000 tonnes within twelve months and 330,000 tonnes in FY27, about 73 percent of nameplate on the near-term figure by desk arithmetic [Sigma Lithium, September 7, 2026]. That guidance now rests on a measurement. Sigma has separately tied the coverage to the November 15 second round of Brazil’s general election and the fact that Minas Gerais is a battleground state, but that is the company’s characterisation, not a finding, and nothing in the decision as reported turns on it. The Federal Public Ministry supported the injunction [Sigma Lithium, September 7, 2026; Brasil de Fato, September 6, 2026].

What to watch

  1. On or about September 19. Parties had 15 days from September 4 to submit questions and name technical assistants to the survey (desk arithmetic on the stated deadline). Whether Sigma engages the survey or attacks the forum shows what it thinks it can win.
  2. On or about October 19. The georeferencing report is due 45 days from the decision. A figure under 8 km converts a preliminary injunction into a durable licensing obligation. A figure above 8 km collapses the case.
  3. The amendment request. N’Golo has asked to extend the consultation and study obligations to the Genipapo Pintos and Jenipapo II communities, and the defendants have objected [Brasil de Fato, September 6, 2026]. Genipapo Pintos is already logged at 3.691 km. If granted, the perimeter problem stops being one community and becomes a district.

The desk’s AI materials index closed at 107.5 on the September 5 update, materials at 106.2 and power at 111.3. Power keeps repricing while the minerals underneath lag. Brazil has just shown that mineral supply can be interrupted with no change in the ground, the price, or the plant.
